1722 - Aug. 17 - New Jersey, Essex Co., Elizabeth Town - a Joseph Marsh made his will:
In the Name of God Amen. The Seventeenth Day of August, In the Year of our Lord and Christ one thousand Seven hundred and and [sic] Twenty Two; And in the Ninth Year of the Reign of our Sovraign Lord George by the Grace of God King of Great Brittain, Ffrance and Ireland, Defendor of the faith &c. I Joseph Marsh of Elizabeth Town in the County of Essex and province of New Jersey yeoman; Being In Competent measure of health of body, And of Good and perfect memory (thanks be to God) Do make this my Last will and
Testament, in manner And form following; That is to Say, first, I bequeath my Soul and Spirit, into the hands of Almighty God who Gave it; my [mortal?] Body, I Commit to the earth, To be Buryed, with Such Charges, And in Such Place, As my Dear wife Sarah, Shall Think Good. And Touching the Distribution of all that Temporal and worldly Estate, which it hath pleased God in his Goodness to bestow upon me, I Dispose of the Same As followeth - (Viz.)
First, I will, that All Such Debts As I shall Justly Owe to Any Person or Persons At my Decease Shall be well and Truly Paid In Convenient Time, Out of my movable Estate, by my Executrix hereafter in this my Last will and Testament named ordained and appointed.
Item, I Give And bequeath unto my Loving and Dearly beloved wife Sarah marsh, my whole movable Estate (after my funeral Charges and Just Debts first Defraid [defrayed] and paid out of the Same) for her use and Improvement, (only so far as shall be necessary for her Comfortable Support and maintenance; And the bringing up of my younger Children without any unnecessary waste) During all the Time she shall Remain Intirely my widow; but, if she shall happen Again to be married; Then, And from thenceforth I Give and bequeath unto my Said wife Sarah (only all that the one Equal Third part, of All such part of my sd. movable Estate, As at the time of her Re-marriage, shall be Left and remaining) to her my said wife Sarah, her Exec'rs, Admin's and Assigns forEver.
Item, I Give and Bequeath unto my Daughter Sarah Watkins for Ever my Iron Kettle, which she formerly Borrowed of me, (And has Since Return'd the Same to me again). And the sum of Twenty Shillings, To be paid to her the Said Sarah Watkins, her heirs, Exec'rs or Assigns, out of the other two thirds my said movable Estate at the Decease or Re-marriage of my said wife Sarah. Which, (with what I have heretofore already given and Delivered unto my said Daughter Sarah Watkins) is all her part and portion of all my whole Estate.
Item, I Give and Bequeath unto the rest of all my Sons and Daughters (excepting and Excluding from and out of the force and Virtue of this bequest the said Sarah Watkins my sd. Daughter) All that the said Other two-Third parts of my sd movable Estate that is to say to such of my Sons and Daughters as shall at the Decease of my said wife (or at the Time of her Re-marriage be for living, if she happen Again to be married) to be Equally Divided To and Amongst them part and part Equal and Alike. And as Touching the Disposision of All my Lands Tenements, and hereditaments, to me belonging and Apertaining, that are situate Lying and being with the Bounds and Limits of Elizabeth Town aforesaid, I will and Devise thereof, and therefore, In manner and form following. that is to Say,
First, I give, grant, Devise, And Bequeath unto Samuel Marsh my Eldest Son, all that tract of Land And meadow (Lying & being at Rahway wch I purchased of Richard Higgins . . . Lying on the East side of ye highway together with a small piece of Land lying at the southwest Corner of the Said Tract by the brook and highway, all that Land highway Is now Said(?) --- And Also all that Tract or Parcel of meadow Lying at the Said Rahway, which I Lately purchased of Edward Jones; To have and to hold, the said ----- Tract or Parcels of Land and Meadow, To the Said Samuel Marsh my Son, his heirs and Assigns forever, To be Possessed thereof when he shall Arrive to the Age of Twenty One years of his life.
Item, I give, Grant & Devise and bequeath unto Joseph Marsh my Son, all that my Tract of Land whereon I now Dwell, with the meadow Adjoining to the same Containing Forty Acres or there abouts be it more or Less. And also all houses, ---- Erections and buildings thereon standing Erected and Built the sd. Tract of Land and meadow being bounded west by the high way, northerly and easterly by a ---- brook and southerly by the Land and Meadow of John Marsh. To be possessed of the Land at the Decease of my Said wife Sarah or if she happens again to be married then at the Time of her Re-marriage; And from thence forth To have and To hold the same Land and meadow, houses, edifices, Erections and buildings, with all privileges and appurtenances thereto belonging unto the said Joseph Marsh my Son, his heirs and assigns for ever.
Item, I give Grant Devise and bequeath unto my Son James Marsh, all that my Tract of Land Lying on the west side of the highway Above mentioned Entained(?) at Twenty five Acres or thereabouts be it more or less and bounded westerly and northerly by the Land of the Said John Marsh and easterly by ---- Rahway(?) To be Possessed thereof at the Decease of my Said wife Sarah or if she happen Again to be married. Then at the Tim of her Re-marriage And from thenceforth To have And To hold, the said Tract of Land with all privileges and Appurtenances To the farm belonging unto the said James Marsh my Son, his heirs and Assigns for Ever.
Item I give Grant Devise and bequeath unto my Two Sons Charles Marsh and Elias Marsh (To be Equaly Divided between them Part and Part Equal and alike, both as to quantity and Quality) All that my Tract of Land which I Lately purchased of John Harriman and William Williamson Lying at Rahway aforesd ------ at Twenty four Acres be it more or less And bounded as in the Deed for the same is mentioned To be Possessed of the Land at the Decease of my said wife Sarah (and Equaly Divided between them my sd Two Sons Charles and Elias both in quantity and quality) or if she shall happen into be married Then at the Time of her Re-marriage And from thenceforth To have and To hold the said Tract of Land with all privileges and Appurtenances to the Land belonging To Them my Said Two Sons Charles and Elias, Their heirs and Assigns for Ever.
And further my will is and is hereby Declared to be that if any one or more of these my five sons above named shall happen to Dy[e] without Issue of his or their body Lawfully to be begotten And before such time as he or they so happening to Dy ought to be possessed of his or their part or parts of my Lands, Tenements, and herediaments above in these --- --- Devised and bequeathed according to the Tenor and true meaning of this my Last will and Testament, That Then and for Such Case ---- or there so happening to Devise (?) aforesd. shall be Equaly Divided Amongst his or their Surviving brother part and part Equal and Alike.
Item I make ordain and appoint My Sd. Dearly beloved wife Sarah the full and sole and only Executrix of this my Last will and Testament, And my Trusty and well beloved friends James Hinkes and Joseph Tooker of Elizabeth Town aforesd. I appoint overseers of ye Land. Praying them in the name of God To see that this my Last will and Testament shall be Executed and performed according to the true intent and meaning of the Same Allowing to them Sufficient and Reasonable satisfaction for all their pains taking therein. And I Do utterly Revoke, nullify and make void all wills and Testaments by me at any Time heretofore In any wise made or Declared, and Do Ratifie Confirm and Establish this to be and Remain my only Last will and Testament by Virtue of the sd. Presents. In witness whereof I the said Joseph Marsh have hereto subscribed my name with my own hand and affixed my Seal this day and year first above written.
