John Hopkins, a native of Kentucky, who in early life followed the stone mason trade, and afterward became a merchant in McLeansboro, Ill., keeping a grocery store till 1833, when he came to Wayne County, near Maulding's Mill, just a little east of where Wayne City now stands. There he sold groceries and dry goods about twelve months, and got sick, and with his whole family returned to Hamilton County, where he died about 1834. His family, after his demise, returned to their old residence, where his widow married Samuel Bradford. [History of Wayne & Clay Counties, IL]

In the name of God amen. I, John Hopkins of the county of the county of Hamilton, being weake body but of sound mind and memory. Do make ordain and establish this to be y last will and testament hereby appoint Benjamin Hood to be the executor of this my last will and testament.
It is my will that all my just debts be paid, that sufficient of my personal property be sold for that purpose, if my outstanding debts which is justly due me is not sufficient, to satisfy all my just debts that I am owing after the payment of all my just debts and funeral expences.[sic]
I do hereby devise and bequeath to my beloved wife the farm and improvements thereon, and which John White now lives on known as W 1/2, NW 28, 5S 6E, 80 acres during her natural life, to take the issues and profits there of after her death I bequeath and divide all my right title and estate of it and to said farm to my son Carlyle Clinton Hopkins, John F.S. Hopkins and Hesterann R. Maulding daughter of the sd. John Hopkins, to be divided equally if the sd. Clinton Hopkins, John Hopkins and Hesteran Maulding can so divide sd. farm and estate as to be equally satisfied in equal parts to have and to hold the same unto them and their heirs and assigns forever.
And if the sd. Carlyle Clinton Hopkins, John F.S. Hopkins and Hesteran R. Maulding cannot so divide sd. land and farm as to be satisfied an each part it is my will that sd. land and farm be sold and the money equally divided between the sd. Carlyle Clinton Hopkins, John F.S. Hopkins and Hesteran R. Maulding and it is further more my will that my beloved wife should have all my personal property and affects after the payment of all my just debts during her natural life and at her death sd. personal property and effects to be sold and the money equally divided between the above Carlyle Clinton Hopkins, John F.S. Hopkins and Hesteran R. Maulding and if my son Carlyle Clinton Hopkins or my son John F.S. Hopkins shall die before my beloved wife, I do in that case bequeath and devise their part of tract of land situated as before described to my other son, his heirs and assigns forever.
In testimony whereof I have hereunto set my hand and fixed my seal this tenth day of September in the year of our Lord one thousand eight hundred and thirty four.

At a court of Probate for sd. County held at my office on the 25 and 29 day of September 1834. This day personally appeared before me Jesse C. Lockwood judge of probate in and for said county in open court Robert Vandeventer and Mason Morris two creditable witnesses who being by me duly sworn on their oaths depon and say that they were present and saw the above named John Hopkins sign the within will and testament in their presence and they believed and still believe that the said John Hopkins was of sound mind and memory at the time of signing the same and that they attested the signing of said will and testament in the presence of each other and at the request of the said John Hopkins.
In testimony whereof I have hereunto set my hand and private seal no public seal being provided this 29th day of September 1834.

By a previous order made at the Hamilton Circuit Court I shall sell at publick vondieu on the 24th of November next between the hours 10 o'clock a.m. and 4 o'clock p.m. at the court house door in McLeansborough all that certain track of land known as West half of the North west quarter of Section No. 28 township 5S, R6E containing 80 acres more or less on a twelve months credit for the puprose of raising money to settle the debts of the estate of John Hopkins deceased the purchaser will be required to give bond and good security together with a mortgage on the premises.

This indenture made this 19th day of August AD 1839 between Jesse C. Lockwood as commissioner appointed by and under a decree of the Hamilton county circuit court _____ in chancery in the cause herein after mentioned of the first part and Carlisle C. Hopkins, John F.S. Hopkins, Hesterann Maulding & Andrew Maulding her husband of the second part.
That Whereas by the decree of said court at the March term AD 1836 in cause pending in said court made a decree as follows to wit, Carlisle C. Hopkins, John F.S. Hopkins, Hesterann Maulding & Andrew Maulding her Husband vs. William Wilson.
And now on this day came the said complainants by Walter B. Scales their solicitor and the said defendant by Gatewood his solicitor and the said defendant filed his answer herein confessing the execution of the bond for a conveyance the receipt of the consideration _____ therein and affirming to convey the said premises and its appearing to the satisfaction of said court that the said John Hopkins has departed this life having at the time of his death Carlisle Clinton Hopkins, John S.F. Hopkins, Hesterann Maulding formerly Hesterann Hopkins but intermarried with the said Andrew Maulding children and the only legal heirs of the said John Hopkins deceased it is therefore ordered considered and decreed by the court that the said William Wilson defendant do within thirty days from the day of reading this decree make execute acknowledge and deliver unto the said Carlisle C. Hopkins, John F.S> Hopkins, Hesterann Maulding the complainants herein and only legal heirs of the said John Hopkins deceased a good and sufficient warranty deed in fee simple to the West half of the North West quarter section Number twenty-eight in Township Number five south range Number Six East of the Third principle meredian with a proper and sufficient dower from and by the wife of the said defendant William Wilson to the said complainants and in default of William Wilson to comply with this decress then Jesse C. Lockwood is hereby appointed a commissioner under this decree to execute, acknowledge and _____ the same according to the time interest and meaning of this decree and it is further ordered and considered that the complainants pay the costs herein etc.
And whereas the said William Wilson has failed to comply with this decree.Now therefore know all men by these presents that I Jesse C. Lockwood party of the first part as such commissioner as aforesaid by virtue of the authority invested by said decree and for and in consideration of the sum of one hundred and sixty paid. Paid to the said William Wilson have sold and conveyed and hereby does grant, bargain alien sell and convey for and on behalf of the said William Wilson as commissioner aforesaid all the avoe recited tract of land to wit the West half of the North west quarter of section No. 28 in T No. 5S R6E of the 3d principle meridian unto the said parties of the second part, their heirs, executors, administrators, and assigns forever. Together with all the outhouses and buildings thereunto appertaining together with all the appertances [sic] and interest that the said William Wilson had to the same and to their own proper use and ______ and also with the like interest in the said tract of land the said defendant had to the same before this decree was entered reserved to the said widow her right of dower if she has any and the said defendant are discharged of all equity of redemption of said land heretofore claimed by him
