  • Make this my last will. I am possessed of and entitled to a considerable sum of money in bank stock, but uncertain whether the sum amounts to 5,000 pounds principal stock, or whether the annual interest or dividend, payable thereon, will amount to 250 pounds sterling should be annually paid to wife Ann Ogle, during her life, out of estate, I hereby devise and direct exs. hereinafter named, shall as soon as conveniently may be placed, hereinafter named, in bank stock, to make up such deficiency as may be of 5,000 pounds principal bank stock.

Glossary of Heraldic Terms
Apropos of the charges on the MacGregor escutheon and the mottoes, the accepted tradition concerning the royal grant of same seems pertinent after a few words concerning the Clan Gregor.
The most widely accepted and popular belief is that the Clan Gregor was founded by Gregor, youngest son of Alpin MacAchaia, King of the Scots of North Britain (Scotland) whose ancestors came from the north of Ireland, then called Scotia and settled on the west coast of North Britain in ARgyleshire.
Alpin reigned from 833 to 836 and fell in the Battle of Argyleshire in the south-western portion of Scotland (Baronage of Scotland by Sir Robert Douglas and Rob Roy by Sir Walter Scott).
The above mentioned Gregor MacAlpin was the founder of the Clan Gregor, hence its First Chief, Laird or Lord and all of his sons were called MacGregor and his descendants constituted the Clan Gregor from Clan which means children, it is said.
Malcolm MacGregor, 8th Chief of the Clan, lived during the reign of David II, King of Scotland, 1125-1155. He was a man of great physical strength and while hunting one day with the king, the latter was attacked by a wild boar which would have slain the king but for Malcolm's intervention. Pulling up an oak sapling and holding it between the king and the beast, he slew the latter with his hunting knife.
The monarch thereupon presented Malcolm with a coat of arms displaying "an oak tree eradicated . . . " (meaning, heraldically, pulled up). Previously, the MacGregor arms had been "a pine tree growing out of a green mount . . . "
Gregor MacGregor was the 12th chief of the clan. He left five sons, Dr. Edward Magruder traces from Gillesspie MacGregor, the harper, third son of Gregor MacGregor (Parish Records of Perth) the descent of the American Alexander McGruder, son of Alexander his great-great-great-grandson
The Magruder family has been exhaustively written up by a number of its representative members, among them Mr. C.C. Magruder, Jr. of Upper Marlboro, the Rev. James Mitchell Magruder of Annapolis and others, in lucid and painstaking articles. Much of this material is easily available in the Year books of the American Clan Gregor Society and elsewhere . . .
To readers who are not familiar with the beginnings of the Magruder family in America, an address in 1923 by Dr. Edward May Magruder, Chieftain of the American Clan Gregor Society furnishes a highly interesting story of the Clan system in general and the Gregor Clan in particular. It was published in the 1923 Year book of the Society, and is a long story which should be read in its entirety. Likewise, a sketch of Clan Gregor in the Year Book, "1909-10 proceedings" in which Major Edward Magruder Tutwiler tells the romantic and tragic story of the Clan in its wilds of the Trossachs, Balquhidder, Rannach and Glenurchy in the fastnesses of North Britain, known as the MacGregor Country.
Dr. Magruder states in his address, as do other historians, that Alexander Magruder (Macruther-MacGruder) was son of Alexander McGruder and Layd Margaret Drummond, widow of Sir Andrew Drummond, Chief or Laird of Ballyclose in Perthshire, Scotland, who was daughter of Sir James Campbell, Laird of Aberchiel (Records of Privy Council of Scotlan, Vol. VIII, 600). . . .
Alexander Magruder, immigrant, was born in Perthshire, Scotland, 1610. His name appears first in the Colonial records in 1653, (Lib. A.B. H, 352 Annap).  An indenture in which Charle Stewart assigns to Alexander Macruder fifty acres of land due unto him for his "wife's adventure into these parts, namely Patuxent."  This was in Octoboer; in November of that year, John Ashcomb assigns fifty acres to Alexander Magruder.
As he appears in Maryland soon after the Battle of Worcester, fought in 1651, it has been assumed that he was among the one hundred and fifty prisoners of war sent out of the realm to the British American Colonies.  They arrived in Virginia, via Barbadoes, and many came later to Maryland.
It is thought that Alexander Magruder may have come with sufficient means to become at once a landed proprietor, say his biographers.  Among the properties acquired were Good Luck, 500 acres; Alexander's Hope, 200 acres; in 1668 Anchovie Hills in the Freshes of Aquasco Creek, 400 acres, which was his home place and the estate with which his name is generally associated.
Dunblane, 250 acres, on west side of Patuxent River adjoining another tract, Alexandria, was surveyed for him, June 26, 1671, also Craig Naigh or Craig Night, 200 acres.  In all, he is said to have acquired 3,750 acres of land lying on both sides of the Patuxent River, owning at the time of his death 2,400 acres.
It is claimed that Alexander Magruder married three times:
  1.  Margaret Braithwaite, whose existence, says Dr. Magruder is entirely traditional, but accepted by genealogists, notwithstanding lack of documentary proof. 
  2. Sarah; proof of this marriage is found in a deed, dated March 11, 1670 (Annap. Prob. Ct. Lib. 4 B No. 7, 445)
  3. Elizabeth, supposedly Hawkins.
In his will (Lib 5 A, fol. 261, Annap.) Alexander Magruder devised to wife, Elizabeth and her three children, two thirds of his personal estate and the plantation "I now live on, 800 acres" for her life time and after her death to his sons Alexander and Nathaniel "or the survivor of them." To sons James and John, 900 acres lying on Western Branch of Patuxent, Alexandria and Dunblane.
To son, Samuel, 500 acres on Western Branch, Good Luck -- etc. 
I will and bequeath the third of my personal estate to my three sons James, Samuel and John . . . at the age of twenty.
To daughter, Elizabeth, 200 acres called Creighnight in Western Branch of Patuxent adjoining my son Samuel's land, etcetera . . . 
Codicil made "in extremis":
That no contest may arise concerning my will, my will is that my eldest two sons, James and Samuel shall enter upon the property left them the fifteenth day of November after my decease -- that my son John shall enter upon his land and receive his portion at eighteen years of age and my daughter Elizabeth, upon hers at fourteen and her portion on day of marriage or at eighteen. Son John and John Beall, executors. January 16, 1731. John Magruder and John Beall appeared in Court November 1735 . . . administration of above estate.

Authorities disagree with respect to the origin of the Cromwell family of Maryland. The favorite hypothesis traces this family back to Sir Oliver Cromwell of Hichen Brook, Knight, and uncle of Oliver Cromwell, the Lord Protector of England.  Sir Oliver had a son, Henry Cromwell, who, it is claimed, came to Virginia in 1620, returned to England, where he married, and had issue: William, John, Richard and Edith Cromwell, the immigrants to Maryland.
There is no evidence to support this claim, neither is there evidence tending to substantiate a claim that the Maryland Cromwells were related in any degree, immediately or remote, to the family of the illustrious Oliver whose ancestral surname was originally Williams. It is fair to state, however, that Thomas Cromwell (1660-1723) of Maryland, a son of William Cromwell, the immigrant, gave the name Oliver to one of his sons.
There were other Cromwell families in England, as acceptable as any of the Hitchen Brook line, albeit less renowned, among which we may, perhaps discover the progenitor of the Cromwells of Maryland. A certain family bearing this surname resided in Wiltshire during the seventeenth century, and it possesses a special interest in the present instance by reason of the duplication of certain baptismal names, peculiar to the English family, in the Maryland family of Cromwell.
The latter settled in the Province prior to 1670. At least, two members of this family, William and John Cromwell, were in Maryland before that year, it is certain. The other two members, Richard and Edith Cromwell, arrived a few years later, perhaps. At any rate, the earliest mention of them in the provincial records is of a later date. We know that William, John and Richard were brothers, and Edith was their sister.
Gen. I Siblings
1. William Cromwell arrived in Maryland in 1667.  He died in 1684. His will was dated 19 June 1680 and filed with the Court on 1 May 1684. William married Elizabeth Trahearne, perhaps a second wife and possibly, herself a widow. She married ca. 1685 George Ashman.

2. John Cromwell d. probably before 1714 intestate. There appears to be neither record of his marriage nor name of his wife, but according to the late Wilson M. Cary, a careful genealogist, John Cromwell had issue.

3. Richard Cromwell will dated 17 Aug. 1717 and was proved 23 Sep. 1717. There is a probability that Richard Cromwell married more than once, for he refers in his will to a "brother-in-law" James Phillips. As he also refers to his "mother-in-law Beeson" (i.e. Margaret Beeson, wife of Thomas Beeson and daughter of George Saughier).  At his death he was married to Elizabeth Beeson, daughter of Thomas & Margaret.

John Cromwell of Wiltshire, England
The will of John Cromwell, of Malmesbury, Wilts, is dated 23 Dec. 1639. He desires to be buried in the churchyard of St. Paul's in the borough of Malmesbury. Heirs: wife Edith, son Phillipp, grandson John, granddaughter Edith, son Richard.

In Malmesbury Abbey Church Registers, the originals of which I have copied, is the following entry under the  Burials - Buryed ye 27th December [1639] John Crumwell of this Towne, one of ye Chiefe Burgesses.

Conclusion - from the foregoing, one may readily see the striking duplication in the baptismal names occurring in these two families - the Cromwells of Maryland and the Crumwells of Wiltshire. These names are William, John, Richard, Edith, Thomas and Philip. It is true that the majority of these names occur also in the immediate family connection of Oliver Cromwell, the Lord Protector of England. In fact, some of these names are in more or less common usage and are not peculiar to any one family, but the name of Edith is sufficiently rare to make its recurrence, along with the other identical baptismal names, a matter of some importance.

I Christopher Gist, immigrant, in Baltimore County before 1682. The will of Christopher "Guest" of Baltimore County, dated 17 February 1690/1, was proved 10 March following (Balto. Co., R.M. no H.S., 331).  He leaves his estate equally between "my dearly beloved wife and childe." His wife is to be executrix. To John Robinson is left a two year old heifer. To "my brother Richard Cromwell's child," a two year old heifer. £5 to "my mother Guest if she be living."
He was married to Elizabeth Cromwell, sister of William, John & Richard Cromwell and she was married three times, 1) Christopher Gist, 2) Joseph Williams & 3) John Beecher and died in 1694. The will of Edith Williams [Beecher] of Patapsco River, Baltimore County, is dated 23 May 1694, but no date of probate is given. Her brother Richard Cromwell and Mrs. Thomas Staley are requested to take "into their custody and tutelage my son Richard Gist, who I request may be put to school and there kept till he can wright and cast accompt fitting for Merchants Business." The same persons are requested to receive and take care of testatrix's estate, and deliver it to her son Richard Gist at 21 years of age (Balto. Co., R.M. no. H.S., 510).
II. Capt. Richard Gist b. in 1684 and died 28 August 1741.  The date of his death is entered in the register of St. Thomas' Church, Baltimore County. Richard married, 7 December 1704 (Friends' Records) Zipporah Murray, daughter of James Murray (d. 1704) of Baltimore County and Jemima his wife, daughter of Capt. Thomas Morgan (d. 1698).  Mrs. Zipporah Gist survived her husband and was living 25 April 1760 when she resigned her dower in some lands conveyed by her sons Christopher and Nathaniel Gist (Balto. Co., B. no. H, 149). She had a brother Josephus Murray.

Christopher - explorer, scout, Indian agent who moved through Virginia, Kentucky, Ohio, North Carolina, South Carolina and Georgia.  He died of smallpox in the summer of 1759 in either South Carolina or Georgia. Christopher married Sarah daughter of Joshua Howard of Baltimore Co., whose will dated 3 July and proved 4 Sept. 1783 (Balto. i, 296) names his sons Francis, Cornelius and Edward Howard and his daughters Sarah, Mary and Violetta Gist and Elizabeth Wells.

3. William b. 1711 according to a deposition made in 1767 wherein he gives his age as 56. he died 19 Nov. 1794 as recorded in the register of St. Thomas' Parish, Baltimore County.  he married 22 Oct. 1737 Violetta daughter of Joshua Howard and sister of Sarah & Mary (above).
4. Thomas b. 1713 according to deposition made in 1767 wherein he gives his age as 54 years (Chancery D.D. no. 2, 179).  His will dated 19 Feb. 1787 was proved 9 Apr. 1788 (Balto., iv, 297). He married 2 July 1735 (St. Paul's) Susan daughter of John Cockey of Baltimore County. She was born 2 Nov. 1714 and died in 1803.

The Charter of Maryland granted to Cecilius Calvert, the first Lord Baltimore, on June 20, 1632, established a proprietary form of government. This meant that Cecilius owned all of the land within the boundaries of the colony. the land was of little value without someone to live on it and work it, so as an incentive to settlement, he proclaimed in 1633, even before the first vessel had left for Maryland, the first of his several Conditions of Plantation. Under the terms of these Conditions, he offered certain amounts of land to those who furnished their own transportation or who provided for the passage of others to Maryland. New Conditions were issued from time to time, but except for a gradual reduction in the quantity of land offered, they remained basically the same.
Typically, the procedure for taking up land under the Conditions of Plantation was for the applicant to appear before the Secretary of the Province and claim a certain number of acres of land for transporting himself and other persons to Maryland. He was required to name each of the persons he had transported. The Secretary then issued a warrant to the Surveyor directing him to layout and survey the specified quantity of land for the applicant and return the certificate of survey to the Secretary's office. The certificate named the person for whom the survey was made, described the boundaries of the land and gave the total acreage of the tract. If the certificate was made out in proper form and there were no conflicting claims, a patent was issued granting the land described in the certificate to the applicant.  The patent was dated, sealed with the great seal of the Province and signed by the Governor, acting for Lord Baltimore in whose name the land was granted.
This is a selective index.  It refers to the name of persons who came into Maryland with the intent of settling there, whether they furnished their own transportation or whether someone else provided it.  Certain words that recur frequently in the Remarks column have a special meaning as used in this index. Immigrated means the individual furnished his own transportation to Maryland, while transported means that someone other than the person indexed paid for his passage. Quite often a person transported is also described as a servant, which means that he had contracted to repay the cost of his transportation by agreeing to act as a servant for a period of years. Under certain of the Conditions of Plantation, a servant was entitled to claim fifty acres of land upon completing his period of servitude satisfactorily. Such claims are indicated by the word service.

Hi, What a great blog! I'm researching John of Mattapany Smith (b.c. 1630 - 1707 Prince George's, Maryland). I read in your Maryland-1 entry of a Margaret Q. Hunt, wife of Francis Hunt and John Smith. Is this the same John Smith whose 2nd wife was Jane Mackay Prather, widow of Jonathan Prather?
