The First Settlement Beyond the Alleghanies - The caption that furnishes the subject for the first chapter of this narration, as above, is not original with the writer, but has been used by other writers and historians as referring to "Draper Meadows" settlement, as well as to be used in reference to the whole settlement of southwest Virginia; but more especially the "Middle New River Settlements." The purpose of the writer is to give the subject a restricted sense. Not in the spirit of controversy or antagonism, but merely to arrive at conclusion, based upon indubitable facts the writer is put to the necessity of showing that the "German New River Settlement," centering in and around the "Horse shoe bottoms" of New River and the mouths of [Tom's] and Stroubles Creeks and extending from this center has priority claims over "Drapers Meadows" by several years.
It is difficult to make a boundary of the first settlers of New River for early, the river valley as an objective was soon filled up by the Germans from Sinking Creek clear to Reed Creek where the settlers were mostly Scotch and Irish with a few of the same scattered here and there between the two creek valleys. There are, however, incontrovertible reasons for affirming that the center and beginning of what Mr. Johnston calls the "Middle New River Settlements" was the famous "Horseshoe Bottoms" and the immediate contiguous bottoms. This Horse Shoe and its contiguous bottoms mean of course, the bottoms at the mouth of T teoms, Stroubles and Back creeks, and these were not only the center and beginning of the "Middle New River Settlements," but were for a period of time, a unit, and as such becomes the "German Settlement of New River." From this common center all movements and settlements were made, including all creeks and valleys between Sinking and Reed Creeks and especially extending up the valleys of Toms and Stroubles Creeks and including the plateau between them. There is no record for settlers on Sinking Creek till 1749, while there were settlers on Reed Creek by 1745, and "Tunker's Bottoms" prior to 1745. Almost as soon as the settlers filled up the bottoms contiguous to the Horse-shoe, they settled next in order, the plateau, around the site of Old St. Michael's - St. Peter's Lutheran Church, which includes the surroundings of Price's Fork. Here settled the Germans which was called the "German New River Settlement" and regarded in the Virginia Historical Magazine by a Lutheran writer as being a "lost" settlement.
We regard, then, as the center of a large area of the New River settlements, the Horse-shoe Bottoms (Faust in his History of the German People in the United States claims that the New River Settlement of Germans extended to Sinking Creek and the Swiss Settlement around Newburn the old County seat of the now Pulaski County) and the Lover's Leap, the geographical center of the more restricted German New River Settlement.
This Horse-shoe Settlement, the stopping point and gateway of all the early expeditioners, including Colonel Walker and his party, the Lincolns, Taylors and others who went to Tennessee and to join Daniel Boone and others in Kentucky, and such was known to Daniel Boone himself.
Augusta and Frederick Counties were formed at the same time and were to include the whole Valley of Virginia and all territory west of them. Augusta, the larger of the two, included a part of the now Bath County and all the southern and southwestern part of the Valley of Virginia, and the whole of southwest Virginia, West Virginia, Kentucky, Ohio, Indiana, Illinois, Michigan and Wisconsin.
We aim to show in this chapter that the German River Settlers of New River were real pioneers.
Most all of the Germans of the New River Settlement were of the farmer type. Their first object was to obtain tracts of fertile land, mill sites and other advantages that go with a permanent settlement.
Others landed as follows: Christian Schmidt (Smith) 1738. The Bargers and Schmidts located on upper Thoms Creek Valley.
In the movements and battles of Cornwallis and Tarrelton about Greensborough, North Carolina, in the Revolutionary War, menaced the people of the Northern part of the Colony of North Carolina as well as those of the southern part of Virginia. In fact they were seriously threatened. General Green appealed to Governor Jefferson of Virginia for help, who in turn appealed to Preston, Sevier, Shelby and Campbell. Accordingly, Colonel William Preston on February 10th, 1781 ordered the Montgomery County militia to assemble at the Lead Mines, and on the day appointed three hundred and fifty men assembled, pursuant to the order of their commander. Major Joseph Cloyd assembled the men of middle New River, which would include the men of Back Creek of now Pulaski County, Thoms and Stroubles Creeks. Also a company went from Wolf Creek under Captain Thomas Shannon and Lieutenant Alexander Marrs. The combined number of these men who answered the call of duty will never be known to historians or to their posterity. But they made themselves felt, fighting against the British near Guilford County Court House (Wentworth) according to reports. Colonel Tarrelton in reporting his southern campaign, page 241, says that "at the battle of Guilford Court House he held the right of the British army and that his troops were badly hurt by backswoodsmen from Virginia."
It has been said that "God's first temples were groves." In the case of New River it was groves and homes and perhaps the larger forts as well as school houses. A fort existed doubtless near the mouth of Thoms Creek, one at Shell's near the mouth of Stroubles Creek, the mound of which is clearly visible in the old Shell Home yard to this day; one such existed at the home of J. Michael Price.

Land Patents & Grants - Patents is the word used up till the Revolution; after that grants. These are given for purposes of locating parties and to give dates. The first patent for old Augusta County is dated June 29, 1739. It is also significant that many of the earlier patents for the county are in and around the New River Settlements.

The pioneers who first settled in the Shenandoah Valley were isolated from the court houses in Spotsylvania and Orange Counties by distance and mountain ranges. Very little information can be found about many of the early settlers. The abstracts of the Northern Neck warrants and surveys provide newly accessible source material. The land records of the proprietor's office of the Northern Neck contain names, dates, locations and family relationships when settlers applied for warrants, transferred land, provided assistance to the surveyors or were otherwise involved.
The distribution into individual ownership of over five and a quarter million acres in the Northern Neck Proprietary followed a pattern. When an individual found a desirable tract of "waste and ungranted" land, he applied to the proprietor's office. A warrant was issued to a surveyor to measure and mark the tract. When the survey was completed, a plat with the land location, description and adjoining land owners was submitted to the office. If there were no infringements on the property of another, a grant was issued to the applicant. Three records resulted from each application if it was carried through to a grant. These records - warrants, surveys and grants - are housed at the Virginia State Library.
The Northern Neck grants have been indexed by the archives staff on 3 x 5 cards, filling 26 card catalog drawers. The microfilm grants are available in large libraries.
The restored warrants and surveys have not been microfilmed. They comprise a separate collection which is generally overlooked by those seeking genealogical material. Sometimes they contain information not found in other records.
There are thousands of warrants, surveys and land transfers. The abstracts which follow are filed under Orange and Augusta Counties. None of the land in these records was within present Augusta County boundaries, but was within its jurisdiction at the time of the transaction. Many of the land owners and much of the land recorded in this volume can be followed in records of other counties as bounty lines were changed.
Information from the warrants and surveys has been combined in the abstracts. Sometimes the adjoining land owners' names were not the same on the warrants and surveys since the applicants were not always certain of adjoining property owners before their surveys were completed.
Additional records for the same general area and time period have been included in this booklet. Filed in a box of "Orange County Tithables and Other Court Records are tithable lists, delinquent tax payers, road petitioners and other records.
The Fairfax Proprietary in Virginia - Virginia's Northern Neck, a vast area of more than 5,000,000 acres between the rivers of Potomac and Rappahannock, is seeped in history: that of both a fledgling colony and that great nation which gave birth to it and of a family whose very name is synonomous with the region.
The 1606 and 1609 charters from James I were granted to individuals operating as, first, stock and then, joint-stock companies. . . . When the Virginia Company was dissolved in 1624, private land ownership in the colony became a reality with the resident governor acting under royal authority, granting title to specific tracts through a document called a patent. No matter the basis of the patent - whether by head right, treasury right, or military right - an annual quit-rent payment was reserved for the Crown.

To obtain a tract of land within the Proprietary, an individual simply appeared before the agent and "suggested" the existence of a specific piece of vacant land. With this 'suggestion' he also paid a set fee, called the 'composition.' The agent then wrote a warrant, directing a specific surveyor to mark the property so described for the individual. It was then the responsibility of the individual (or his assignee) to arrange for the survey of the specified tract.
Once the survey was completed, it, along with the warrant on which it was based, was returned to the Proprietary Offices where the agent, acting on behalf of the Proprietors, gave title in fee simple through an instrument called a grant. Title was based "on composition for use paid and for the annual rent hereafter reserved." This annual rent, first stated at two shillings sterling per 100 acres, was from about 1702 stated as one shilling sterling per 50 acres.
An original parchment of the grant was given the owner, the document was recorded in a large bound volume, and the warrant, survey and any supplemental accompanying papers were filed. These supplemental papers include letters, court documents, abstracts from church registers and family Bibles and affadivits.

Settlement began in the 1720's in the section of Virginia's Northern Neck west of the Blue Ridge Mountains. Acquiring land was a major objective of the early pioneers. The Northern Neck Proprietary, in control of over five and a quarter million acres, was prepared to supply land to the settlers for a reasonable fee.
Frederick County was formed from Orange in 1738. The court did not begin to function until 1743 when there was a sufficient number of tithables to support a local government. Frederick County covered a large area which included the present counties of Frederick, Shenandoah, Berkeley, Jefferson, Morgan, Clarke and portions of Hampshire, Hardy and Warren.
