Joseph Truman or Trueman

Biography: He was born in Nottinghamshire, England. He married in England but neither his wife's name, nor the name of her family has yet been ascertained. He appeared with his wife, and perhaps some of his children, at New London, Connecticut in 1666. In the following year he was chosen constable, a position of considerable honor in those days. He purchased in 1667 from Alex. Piggins, and about 1670 from Hugh Roberts, some pits for tanning, which were located in a meadow near the entrance of Cape Ann Lane. Truman Brook and Truman Street are named after him and his family. The brook ran into Bream Cove near the Hempstead lot. He appears as plaintiff in law suits in October 1682, May 1683, October 1683 and May 1685. He died in 1697 at New London, Connecticut. In his will, executed in September 1696, he mentions four children, Joseph, Thomas, Elizabeth and Mary, his daughter Ann having died before the will was made. In a note-book now [1901] in the possession of of Lucy Greene of Denver, Colorado, which was owned by her great-grandfather, Jonathan Truman, appears the following entry in 1822: "Jonathan Truman, owner of this book, is the son of Jonathan Truman born at New London, June 25, 1730. He was the son of Thomas Truman who was also born at New London. His father who was named Joseph, came to America from England (Nottinghamshire), in company with a brother who settled in Virginia. He left at New London two sons, Joseph and Thomas, and a number of daughters."

1682 - October - Hartford or New London, CT - lawsuit between Joseph Truman and John Higley:

Whereas Joseph Trueman has complayned to this Court that he is greatly prejudiced by an execution that was served upon John Higley, for a judgment of court he recovered against him at New London, September 20th, [16]81 for 26 galons of Rume and cost of court, one pound ten shillings and sixpence, the execution being levyed upon two hundred seventy one yardes of old statute lace, and apprized to answer the judgment. The Court having viewed the execution and the lace cannot judg it of a quarter of the value of the judgment, and therefore that righteousness may be attended in this case doe order that the Marshall doe return the lace to the sayd Higly, and that he demand him to prsent the estate granted by judgment, and in defect or want of that estate some other good and pasable estate he is to present for execution, and if he doe refuse to make such presentation, the Marshall is to levy the execution upon the body of the sayd Higly; and this Court appoynts Mr. John Loomys and Tho. Stoton and Mr. John Fyler to be apprizers of what shall be seized by execution.

1683 - May - New London, CT - lawsuit continued:

 In answer to John Higley's request, This Court haveing October last, ordered a new execution to goe out against Higley's estate to answer a judgment of court Joseph Trueman obteyned against Mr. Higley at New London court Septr. 20, 1681. This Court doe now see reason to repeale the former order for a new execution and doe grant Joseph Trueman liberty to prosecute his case against John Higley, by way of appeale, at the Court of Assistants, October next.

1683 - October - Hartford, CT - lawsuit continued:

Upon the petition of Mr. Steven Richardson that he might have liberty to appeale from the judgment of the county court at New London, June last, wherein Joseph Trueman was plntf. against him, This Court haveing considered the petition of Mr. Richardson, and findeing that that Court where Mr. Richardson did review to, fell, by the providence of God. This Court grants that Mr. Richardson should have liberty to appeale from the afoarsd judgment of the court, to the next Court of Assistants in May, providing he enter his appeale in the records of the court of New London and give the sayd Treuman timely notice thereof. 

1685 - May - Hartford, CT - lawsuit continued:

In answer to the motion of Richard Edwards, this Court grants Joseph Trueman liberty to prosecute John Higly at the Court of Assistants in October next. 

1685 - October 1 - Hartford, CT - Joseph Truman involved in a court case:

Joseph Truman is Plaintiff, Contra John Higley Defendant, which Action was thus Entered at New London Court, Viz't. An Action of the Case for Neglecting to pay the balance of his accompt in rumm, according to promise. In this Action, the Jury did find for the Plaintiff, Twenty Six Gallons of Rumm, and Cost of Court, Cost allowed is Thirty Shillings & Six pounds. In this Action the Jury now find for the Plaintiff Twenty Six Shillings & two pence in New England money, and Cost of Court, Cost allowed is fifteen Shillings. - The Court Ordered the Lace taken by Execution, to be delivered to John Higley, which was Tendered to him in Court and he refused to Accept of it. Cost of Court is Thirty Two Shillings - Execution delivered April 16th 1686. 

1697 - September - New London, CT - Joseph Truman wrote his will:

The Last Will and Testament of Joseph Truman

In the name of God amen I Joseph Truman being sick & weak in body but through the mercy of God Injoy the use of my Reason & understanding:  Doe now make my Last Will & Testament

Imp: I Doe Give my Soul into the hands of Almighty God --- him to R--- it in & through the --- & --- of the Lord Jesus Christ my only Savior and --- Redeemer & my body to the Earth to be Desently buried by my friends & executors.  And for what of worldly Goods the Lord hath been pleased to bestow upon me I Dispose of as followeth:

I Give and bequeath unto my two sons Joseph & Thomas Truman all my housing and Tanyard(?) with the stock of Leather and hides and all the Lands about my housing and fields(?) --- thereon together with what Calls(?) or house(?) kinds I have with all the Debts Due to me from any person whatsoever to be Equally Divided between them and if either of them shall happen to Dye without any heirs then the whole of this Estate to go to the survivor his or their heris and assigns after my wives decease.

I Give to my Loving wife one third part of all my personal and Reall Estate During her Life and Appoint for my Executrix and Desire my friend Capt. Daniel ---- to be --- and assisting of her as occasion may Require. 

I Give to my two Daughters Elizabeth and Mary Truman all my household furniture to be Equally Divided between them after my wives Decease(?) In testimony hereunto I have Set my hand and Seal New London, September --- Joseph Truman

1728 - April 20 - New London, CT - Joseph's estate was divided amongst his heirs

Wee the Subscribers being appointed by a Court of Probates Held in New London April 20th 1728 to divide the estate of Joseph Truman Late of New London dec'd. --- --- which was in Equal parts between his sons Joseph and Thomas and being Sworn to that service we divided the s'd. Estate as follows:

first Wee divided and Sett out to Joseph Truman the Southern most part of the Mansion house standing on the Land of ye Testator to begin from the middle of the Chimney and so through the sd Chimney. That Joseph shall have half the Chimney with the oven Standing in sd Room with free liberty to go into the other part of the house to repair and --- the sd Oven as occasion shall call for and to go round the sd House to repair sd house as need shall require. 

And we Sett out and divided unto Joseph his part of the Land as follows. beginning att ye --- East Corner of Thomas his part of the mansion house and runs in a direct line to the middle of ye body at ye --- of a --- --- --- And from thence Eight feet northerly to a moor stone standing in Capt. Joshua Hempstead stone wall --- and from thence Westerly to the Corner of S. Wall and from thence Southerly to as the --- stands to the South East Corner of Capt. Joshua Hempsteads lott and from thence Easterly with the high way to the remains of the Stone wall to be mark in T. Wall namely Thos the W H & T, a little westward of Thomas Truman's --- house and from thence a straight line --- --- Cows Shedd --- Easterly from the Southeast Corner of Joseph's part of the Mansion house. 

2dly. Wee sett out and Divided unto Joseph the one halfe a piece of Land lying upon Bream Cove beginning at the North West Corner of Thomas Coit(?) --- and --- thence Westerly by the high Way Two Rods eight feet & three poles --- --- from thence Southerly two Rods to a moor Stone (?) and from thence Easterly two Rods & eight feet --- to the sd Thomas Coits --- and from thence Northerly -- Thomas Coits fence --- to the first Station.

3dly wee Sett out and Divided unto Thomas the northern west part of the Mansion house standing on ye land of ye testators to begin from the middle of the Chimney and so through the sd. Chimney, That Thomas shall have halfe the Chimney with the oven Standing in sd. Room with free liberty to Go into the other part of ye house to repair and --- the sd oven as occasion shall call for and to go round the sd House to repair sd as need shall require. 

and we sett out and divided unto Thomas his part of the Land as follows beginning att the Moor Stones (?) in the Wall of Capt. Hampstead(?) afforsd. and run thence Easterly to the Land of Mr. John Carter(?) and from thence -- Mr. Coits fence stands to the high Way and from thence Westerly with the highway to the Remains of a Stone Wall that bounds between Thomas and Joseph afforsd att the high way And bounded from thence by the Land Sett out to Joseph to the first Station

4thly we Sett out and Divided unto Thomas the one halfe a piece of Land lying att Bream Cove beginning att the North West Corner of Josephs part of sd Land att a moor stone and runs thence Westerly Two Rods & Eight Feet & --- --- to a moore stone that bounds between this land and the Land of Capt. Joshua Hempstead and from thence Southerly Two Rods to a  moor Stone and from thence Easterly Two Rods Eight feet and -- --- to a moor stone that bounds between Thomas and Josephs and from thence northerly to the first Station.

and the Entry way that belongs to the Sd Mansion house shall be divided and refraimed(?) as the partition  now stands in sd Entry way and also the Chimney Way on the bakc side of sd Houses shall always be refraimed(?) by each party from the end 000 of the Chimney afforsd. and itt is Intended that the sd large --- --- shall be divided upon a --- --- Viz't at the way that --- on Josephs Land shall be his and at the way that --- on Thomas Land shall be his.
