1752 - Dec. 19 James wrote his will:
In the name of God this nineteenth day of December in the year of Our Lord One Thousand Seven Hundred and fifty two. I James Clark of the Burro: of Elizabeth and County of Essex and province of East Jersey yeoman being very Sick and weak in Body but of perfect mind and memory thanks be unto God for it Calling to mind the mortality of my Body and knowing that it is appointed for all men once to Die Do make and Ordain this my last Will and Testament that is to say Principally and first of all I Give and recommend my Soul into the hands of him that gave it and for my Body I recommend it to the Earth to be Buried in a Christian like manner at the discretion of my Executors nothing doubting but at the last General Resurrection I shall receive the same by the mighty Power of God and as touching such Worldly Estate wherewith it has pleased God to bless me with in this life. I Give Devise and dispose of the same in the following manner and form 
Imprimis it is my Will and I do Order that in the first place all my  just Debts and Funeral Charges be paid and satisfied. 
Item I Give and bequeath unto Anne my well beloved wife one half of all my moveable Estate together with the use of all my Lands until my Sons Come of age. 
Item I give to my Eldest Son Jeremiah six acres joyning to the back side of the Home Lott and a Lot of meadow joyning to Recompense Stanberry containing Two acres and threee quarters to him, his Heirs and assigns forever.  
Item I give to my Second Son Elias the remaining part of the abovesaid Lot Bounding on Isaac Hetfield, Benja. Wynans and David marsh and the said Elias at the age of twenty two years shall pay the sum of five pounds to each of my two Daughters Rachel and Mary Ann then the said Land to him his Heirs and assigns forever.  
Item I give to my third son James a Lot of Land Purchased of Lewis Terrill containing six acres and a piece of meadow given me by my father to him his Heirs and assigns for ever.  
Item I give to my two Daughters Rachel and Mary Ann the other half of my moveable Estate together with the Sum of twenty seven pound to be paid by my Brother Samuel to be equally Divided.  
I likewise constitute appoint and ordain my loving wife and Recompense Stanberry Executors to this my last Will and Testament and do hereby utterly dis--- and revoke all and every other former Testaments Will Legacies and Executors by me any ways before this time named Willed or bequeathed ratifying and confirming this and no other to be my last will and Testament In Witness whereof I have hereunto set my hand and seal this day and year first above written.

1753 - Feb. 24 - the will was proved in Essex County, New Jersey:
Rob't. More and John Joline two of the witnesses to the within written will being sworn on the holy Evangelist of Almighty God did severally Depose that they saw James Clark the Testator within named Sign and Seal the same and heard him publish pronounce Declare the within Instrument to be his last Will and Testament and that at the doing thereof the said Testator was of sound and disposing mind and memory as far as those Deponents know and as they verily believe and that Sarah Craig the other Subscribing Witness to the said Will was present and Signed her name as Witness to the said Will together with those Deponants in the Presents of the Said Testator.

Anna Clark Executrix and Recompense Stanborough Executor in the within Testament named being Sworn on this holy Evangelist of Almighty God did Dispose that the within Instrument Contains the true last will and Testament of James Clark the Testator herein named so far as they know and verily believe and that they will well and truly perform the same by Paying first the Debts of the Said Deceased and then the Legacies in the said Testament ----- so far as the Goods Chattels and Credits of the said Deceased can thereunto Extend and that they will make and exhibit into the Prerogative Office at Perth Amboy a true and perfect Inventory of all and Singular the goods and Credits of the said Deceased that shall come to their knowledge or possession or to the possession of any other Person or Persons for those ---- and render a just and true account when thereunto lawfully require.
