The Barnes Manuscripts Collection in the William Henry Smith Memorial Library comes from the Detroit Public Library, which donated the material to the Indiana Historical Society because of its Indiana focus. The collection contains general correspondence for several nineteenth-century Hoosiers.  It also incorporates legal forms for fifty-five Indiana counties, dated from 1833 to 1925, including warranty deeds, mortgages, bonds, title abstracts, memorandums of agreement, estate inventories, and court proceedings. Legal forms from Parke County were abstracted for this first installment of a multi-part article.  
Bond. 4/16/1858, Robert Wright & Prien Wright were bound to Christian Fether huff "and other Petitioners" for $!50.  On April 10, the Sugar Creek Township trustees had ruled in an unstated case against Robert Wright and in favor of Fetherhuff and others. Wright appealed to the Parke County Board of Commissioners, and the bond was conditional upon Wright's winning his appeal and paying the costs, both past and future.  Signed and sealed by Robert Wright and Prien Wright.  Taken and approved on April 16, 1858.  James Bradford, clerk, attested.  Filed March 4, 1848 [sic?] by J. Potts, auditor

Year round - salt pork, potatoes, corn and oat meal, bread, milk, cheese and butter
Spring & Summer - fresh greens (dandelion, polk, lamb's quarter, etc. ), eggs, maple syrup, honey, fish and eels, fresh vegetables, squirrel
Fall & Winter - venison, pigeons, wild geese, partridge, chicken, turkey, rabbits, preserved meat from livestock (salt pork, sausage, smoked ham), dried apples, root vegetables (carrots, turnips, onions, potatoes)
Hamblen Township - the name of the first settler is unknown, but by 1824 there were ten or twelve families living in the area. Pioneers came from Jackson County by way of the Three Notch Trail or south from Johnson County or west from Columbus and Taylorsville and other areas of western Bartholomew County. 
The first settlers settled in a three mile strip of land that was the western boundary of Bartholomew County, along with the unsettled territory that was to be overseen Bartholomew County. The first settlement was probably the Taggart settlement. Later, Taggart was at the junction of Three Notch Trail (a north-south stagecoach route) and the east-west stagecoach route between Columbus and Bloomington. Taggart was just east of the junction of Upper Salt Creek and Hamblen Creek. Hamblen Creek is now called Sweetwater Creek. Another trail was north from Taggart it followed the ridge of Mt. Moriah past the Hamblen homestead and east to Taylorsville.  Job Hamblen may have been the first settler however James Taggart Sr. was the first to file for land. Job Hamblen died before he could file, but his son filed a short time after his death. 
A few people, before 1834, had agitated for a new county in order to escape justice and protect themselves from the law in a new county.  They counted on their friends to help them hide.  Other counties in the 1830s had similar problems with settlers who had fled from arrest in eastern states. 
Historical evidence corroborated that this element existed in Brown County for some years.  Little Blue Creek in southern Brown County did indeed; at that time have an unenviable reputation as a place of rendezvous for horse thieves, ruffians and fugitives from justice. 
The county was formed by the state legislature on Feb. 4, 1836 out of parts of Jackson, Monroe and Bartholomew.  On July 25, 1836 the county commissioners met and created four townships of equal size: Hamblen, Van Buren, Johnson and Jackson.  On August 15, 1836 they created a fifth township called Washington from the other four.
Eliakim Hamblen, a son of of Job Hamblen, suggested to the commissioners that the northeast township be named for his father, who was a Revolutionary War soldier, and the first settler in the area where he lived and died.

This article is the first in a two-part series on court records and legal documents from Indiana's territorial period. Until recently the handwritten order books have only been available in their original format at the Indiana State Archives.  In 2014 the Historical Society of the United States District Court for the Southern District of Indiana and University Library at Indiana University-Purdue University, Indianapolis partnered in an application for an Indiana SHRAB grant to digitize and make searchable the General Court Order Books.  All of the order books, including the Chancery Court records are either in the process of entry into the IUPUI library website or are already available at http://www.ulib.iupui.edu/collections/ITCO.

Wright, Aaron - Juliann Wright - Authorized Aaron Wright of Marion County, to file a bill of chancery for a divorce in Marion Circuit Court, from Juliann Wright, his wife; without having to prove the one year Indiana citizenship prior to filing. Authorized the court to grant the divorce if otherwise entitled.  This act in force after passage.  Approved Jan. 12, 1850. (L-1850, p. 87)

Cornwell Family Cemetery
Location: Stamperscreek Township, Sec. 12, T1N, -RE, abandoned
Peter Cornwell, born in Virginia and married in Kentucky, went to Kentucky, then came to Orange County, Indiana in 1815. This farm where he settled belongs to some of his descendants.  For many years this was called the A.J. Pickens farm, Mrs. Pickens having married Nancy Cornwell.  There are perhaps 10 graves in this neglected burial plot, only one of which has an inscription.  The stone is broken and leans against a tree which has grown up in the group of graves.  The well cut inscription is viz:
Sacred to the memory of Peter Cornwell, who was born 12 June 1780.  Married 1 June 1802.  Died 1 Oct. 1842. 
Elizabeth Arterburn Cornwell, wife of Peter is known to be buried there.  She died after Oct. 1842, as she is named in his will. Descendants of this couple are buried in the Stamperscreek Church Cemetery in Paoli Township. 
[Wolfe Cemetery]
Location: Stamperscreek Township, Sec. 18, T1N, R1E
Located in the north west quarter of the section, on the Henry Wolfe farm, now owned by Charley Trinkle, Henry Wolfe was born in Virginia, and with his wife, Lucy Grigsby Wolfe, came to this county from Kentucky in 1813.  They were the parents of 12 children.  The parents of Henry, John and Elizabeth Cornwell Wolfe, are said to have come here also. If so, they are probably buried in this family graveyard.  There are several graves with no inscribed markers.  The inscriptions were copied by Mr. Ermal Coulter, RFD, Paoli.

Mary Bruner - daughter of Andrew & Elizabeth Shirley Wilson was born in Orange Co., June 4, 1820.  She married Alfred Bruner Dec. 29, 1836.  Mary died Feb. 7, 1913.  She and Alfred had ten children, five of whom preceded her in death: Joseph W. , Elizabeth, Luther M., Newton T. & Amanda J. Living in 1913: Hester A. wife of Joseph Bruner, Nancy A. wife of Joel Halbert, Mariah B. wife of John Mills, Ellen B. wife of James H. Hudelson and Alfred Wilson Bruner.  Alfred Bruner Sr. died in Sept. 1899.  
Oct. 1937 Tolivers Celebrate Golden Wedding
Mr. and Mrs. M.V. Toliver of the Old Union neighborhood were delightfully surprised Sunday morning when 150 friends and relatives arrived to help them celebrate their golden wedding anniversary. 
At the noon hour a bountiful mean was served this large crowd.  Twenty-five cakes graced one table.  One cake was baked by Aunt Jane Pruett, who is 85 years old.  It was a large butter cake decorated beautifully with golden colored bells.
An interesting and appropriate program was given in the afternoon.
Those taking part in the musical program were the Brooks quartet, Mrs. Paul Mills, Mrs. Dol Quakenbush, Mrs. James Lindley, Rev. and Mrs. Barker and Mat Toliver. 
Rev. Baker, of Jeffersonville, and Rev. Keys gave inspiring talks and offered a prayer of Thanksgiving for the lives of such people as Mr. and Mrs. Toliver. 
John Stackhouse of French Lick gave a most interesting sketch of the school days courtship and wedding of the couple.
A beautiful basket of gold colored flowers was presented by Rev. Key as a token of appreciation from the Ladies of the church. Many beautiful and useful gifts were received by Mr. and Mrs. Toliver.
The remainder of the afternoon was spent in pleasant conversation and in congratulating this worthy couple. 
Bidding Mr. and Mrs. Toliver "God's Speed" the crowd disbanded, all voting the day as one well spent and one long to be remembered.  
Some from a distance who attended the Golden Wedding Celebration were Dr. and Mrs. Toliver of French Lick, Mrs. Dol Quackenbush of Madison, Wis., Mrs. Paul Mills, of Columbus, Mrs and Mrs Marion Toliver of Indianapolis and Mr. and Mrs. John A. Stackhouse Jr. of Louisville.
