It was on 16 June, 1774, when James Harrod and his party of pioneer settlers reached the plateau between the Salt and Kentucky Rivers in the heart of a land that would one day be called Kentucky. Physically exhausted from their long trip down the Ohio and up the Kentucky River and fearful of the ever present danger from roving bands of Indians, they gave no thought to the restless discontent of their counterparts who lived along the Eastern seaboard. Uppermost in their minds was survival.

Acutely aware that they had penetrated deep within enemy territory, they immediately set about laying out Harrod's Town. . . . 

They were followed shortly by Daniel Boone, Benjamin Logan, John Floyd, Simon Kenton and numerous other pioneer leaders. Their greatest enemy, or so they believed was the Indian. They could not have known that Fate was already laying the groundwork that would lead the Eastern seaboard revolutionary and the Western pioneer to a common goal, a goal to establish a permanent home which was destined to erupt into a long and vicious legal war. 

Unfortunately, many of the earliest settlers believing that just to settle the land was all that was necessary for ownership delayed too long the registration of their surveys and claims. Apparently

they though this was a relatively small item to be taken care of only after the more demanding responsibilities of their rugged existence had been met. They were mistaken. Even before these soldiers of the American Revolution were rewarded with generous land grants in the Western wilderness, large companies and private speculators were sending surveyors into the choice Bluegrass lands to record, in orderly process landmarks and boundaries were overlapping the earlier settlers' claims.

When the news of the first preemption reached the original settlers, the shock reverberated from fort to fort and cabin to cabin. In utter disbelief and dismay, frontier giants were forced to stand aside while their beloved lands, so hard won by blood, sweat and tears, passed irrevocably into the eager hands of Eastern speculators and newcomers. . . . 

An historical phenomena that was to affect Kentucky for generations arose from this sad situation as it attracted the greatest legal talent known from Virginia, Pennsylvania, North Carolina and even the eastern seaboard. They came to Kentucky to practice their profession and in doing so helped establish a workable solution out of organized chaos. They accomplished this by compromise, oration, their knowledge of land and, in some instances, by personal ability to successfully arbitrate. Some of the outstanding people were Henry Clay, James Taylor, Ben Hardin, George Robertson, James Harlan, John Breckinridge, Humphrey Marshall, Alexander Scott Bullitt, George Nicholas, Benjamin Sebastian, Harry Innes, Joseph Hamilton Daviess, Caleb Wallace, Christopher Greenup and many others too numerous to mention. . . . 

After 1792, when Kentucky became a state, land claims were filed in the various county court houses and later placed in the Secretary of State's Office. Although they were always available to the public, the disorderly collation of pages made them practically useless. It was not unusual to find a missing survey or grant supposedly found on a certain page of Volume I resting snugly within the hard bound covers of Volume IV. . . . 

Procedure to Play the Old Kentucky Surveys & Grants - First, obtain the Index of Topographic Maps of Kentucky prepared by the United States Geological Survey in cooperation with the Commonwealth of Kentucky, suggested scale of 7.5 minute quadrangles (Scale 1:24,000 one inch equals 2000 feet).   . . . 

After the quads of the area to be reconstructed are secured, they should be placed together. Preferably, one should [print] duplicates of the quads so that one copy can be used as a work sheet. It is well to use a pencil on the first draft so that errors can be erased easily. It is also helpful to use different colors of ink to denote various types of grants and surveys, treasury warrants, military warrants, head-right, pre-emption, and such on your final product. 

The second step in reconstruction is to reduce the actual Kentucky surveys to a scale that will correspond to the scale of the topo or quad sheet so that the reconstruction will be joined accurately.  

The surveys of Kentucky lands are described in 'metes and bounds,' such as: "Beginning at a Big Sulphur Lick, running on the creek and binding thereon West 34 poles S 82 W 34 poles N 78 W 40 poles . . . " The distance in each 'call' of a survey or deed is expressed in 'poles' (one pole equals 16 1/2 feet). To convert poles to feet on a reduced scale to place onto the US topo or quad sheet merely multiply the number of poles in each call by the number of feet. . . . 

Natural markers and monuments such as trees, streams, cliffs, ridges, or anything which occurs in nature and which is described in the survey or deed takes precedence over the calls themselves. For example, should a survey call for a given line to run from the mouth of Beaver Creek to the mouth of Boyd's Creek 700 poles, the law provides the line must run from creek to creek regardless of whether the distance mentioned is shorter or longer. This last call instructs the draftsman to proceed 'to the beginning.' The law provides in this manner so that the boundary lines of each survey will close. 

In the process of reconstruction it is important to place inside the boundaries each survey recomposed onto the quad, or in a footnote, the type of land grant under which the survey was authorized, the number of the warrant, original owner, assignees, date of entries, date of survey, principal surveyor, county of location, name of deputy surveyor, his crewmen such as chain carriers and the marker; and in some instances, the 'housekeeper' which was required to prove the bona-fide residency, acreage, book and page of recordation, and whether the land was 'caveated' (claimed by another), the natural markers and monuments, adjoining and/or former owners.

 For such purposes as mentioned above, the draftsman may want to develop his own code for abbreviations, such as: TW for Treasury Warrant, MW for Military Warrant, or S for Survey, CC for chain carriers, M for the marker of the trees, PS for principal surveyor who had to approve the original survey, DS for deputy surveyor, and so on. Also, as the draftsman composes his work, he should record on the new map the names of old forts and stations, trails and traces, salt licks, buffalo trails, and other notations such as 'where the British camped,' 'old encampment,' 'old Indian village,' to mention a few examples. 

The reduction of the actual description in Kentucky surveys and grants can be accomplished easily by the use of a surveyor's protractor which gives the 'bearing angle' off of North or South. Should the angle in the call vary from the natural marker or monument, the latter control so that by law the survey will close. To scale the distance called for in the description along the bearing angle mentioned, use the protractor and with a pencil lightly mark each end of the angle, then proceed with an engineer's scale which is graduated on inch equals 2000 feet to mark the final line, thus obtaining the accurate reduction to the scale of the topo sheet. Local surveyors are most helpful in advising on mapping procedure. . . .

Genealogists can derive much information from reconstructed maps. For this reason, it is most important that each marker and monument, trails and traces, and each feature of nature mentioned as such in the survey, whether in the identity location preface to the actual description or within the description be annotated upon the newly composed map.

The salt licks are very important. Here the buffalo made the traces to each lick. Some of these licks endure even today evidencing many factors important to geologists. . . .

It is stated by Collins, and other historians, that the first surveys made in what is now Kentucky were made by a party under Captain Thomas Bullitt, at the mouth of Beargrass Creek, in July 1773, who was immediately followed by other Deputy Surveyors working under Col. William Preston, Surveyor of Fincastle County, Virginia. 

At that time Fincastle County comprised all of what is now the State of Kentucky with the exception of the eight counties lying west of the Tennessee River, embracing what was later the Jackson Purchase, bought from the Indians in 1818. 

The name of Fincastle County was retained until December 31, 1776, when Kentucky County was formed from a part of Fincastle. 

November 1, 1780, Kentucky County was divided into three counties: Fayette included "all that territory beginning at the mouth of the Kentucky River, and extending up its middle fork to the head, and embracing the norther and eastern portion of the present State."

Jefferson then embraced "that part of the south side of the Kentucky River which lies west and north of a line beginning at the mouth of Benson's big creek, and running up the same and its main fork to the head; thence south to the nearest waters of Hammond's Creek, and down the same to its junction with the Town Fork of Salt River; thence south to Green River and down the same to its junction with the Ohio. 

Lincoln County included the rest of the State south of the middle fork of the Kentucky and east of the Jefferson line. . . . 

Dr. H.R. McIlvaine, Librarian of the State of Virginia, states that about the time Kentucky entered the Union as a sovereign State, June 1, 1792, that "Virginia passed a law giving to Kentucky all the original papers - plats and applicant's descriptions - affecting land in Kentucky, and, so far as the land books are concerned, there are copies in Frankfort of the parts of them concerning Kentucky lands, and only in Frankfort are to be found the original papers, these having been given by Virginia to Kentucky." 

The surveys, which were sent by Virginia to Kentucky, are all contained in one cabinet, of ninety metal file cases, containing about sixteen thousand plats and surveys. These papers were evidently boxed up and badly mixed in the shipping, and when received, were indexed just as they were, without being sorted in any manner before indexing; then indexed only in the name of the person for whom the survey was made, disregarding the name of the person to whom the original warrant was issued. 

The large majority of surveys were made on Land Office Treasury Warrants, on Pre-emption Warrants and on Settlement Warrants, and while it is known that surveys were made in 1773, none have been found bearing date earlier than March 14, 1774, nor later than May 28, 1789, though these may still be found. . . .
